Pamela: For nearly two decades, the U.S. government has used a loophole in Section 702 of the Foreign Intelligence Surveillance Act to surveil everyone from campaign donors to journalists to protestors across the political spectrum.
Congress worked to close this loophole by blocking the program’s extension earlier this year, but the surveillance hasn’t stopped: in March, the Foreign Intelligence Surveillance Court recertified the program for another year.
Trump and Stephen Miller have long championed Section 702. Now, with Jay Clayton — a Trump loyalist who has helped weaponize the government against political enemies and bought into Trump’s election conspiracy lies — newly confirmed as their Director of National Intelligence, the era of warrantless surveillance is set to become even more dangerous.
Advocacy from activists and movement partners alike helped ensure Section 702 lapsed, but Clayton’s confirmation is expected to wrench the negotiations back open, and that means our privacy is at risk. So, we need to get loud:
