Donald Trump is attacking our voting rights while destroying the venerable United States Postal Service—and the Supreme Court is helping him do it.
Here's the breakdown of the situation:
Trump is trying to destroy mail-in voting. We know this because he won't stop ranting about it on his social media, calling mail-in ballots "CROOKED, CORRUPT, & DESTABILIZING."1 He hates it because more Democrats than Republicans vote by mail, and he thinks this threatens his and MAGA Republicans' electoral outcomes. Even though he votes by mail himself.2
The truth is that mail-in ballots are popular with voters from all parties. Forty-eight million American voters voted by mail in the 2024 presidential election—nearly a third of all ballots cast.3 In an election Trump won! And Trump has voted by mail twice this year!
No matter what Trump says, voting by mail is safe, secure, convenient, and for many people, the only accessible way they can cast a ballot. Seniors, voters with disabilities, rural voters, Native American communities, military families, students, caregivers, and working people all rely on the mail to exercise their right to vote.4
But in March, Trump signed an executive order on voting by mail. The order forces the U.S. Postal Service to not deliver mail-in ballots to registered voters the federal government has decided are ineligible, in coordination with the Department of Homeland Security.5,6 States have sounded the alarm that inaccuracies in this new system could prevent eligible voters from casting their ballots by mail.
Then, a legal battle ensued to block Trump's order. Dozens of Democratic state attorneys general sued because the order is unconstitutional. The federal government doesn't have primary authority for administering elections, the states do.7 A lower court agreed and blocked key parts of Trump's executive order.8
Now, the Supreme Court, with its conservative majority, ruled in Trump's favor. Last week, the Supreme Court paused the lower court's ruling that blocked Trump's executive order. In her dissenting opinion, Justice Ketanji Brown Jackson wrote that the Supreme Court's decision "needlessly injects chaos and uncertainty into the upcoming midterm elections."9
States continue to fight this in court.10 A federal judge has once again blocked the USPS rule while litigation continues. But this will be appealed and could be overturned at any time.11
Chaos and uncertainty is exactly what Trump and MAGA Republicans want in the midterms. They want to frighten voters, suppress voter turnout, and keep the American people from voting them out of office.
