Today, the Supreme Court heard arguments on whether all children born in the United States can continue to automatically receive citizenship.1
Supreme Court justices appeared skeptical of arguments being made by the Trump administration, but the fight is far from over. Trump showed up to listen to arguments, making him the first sitting president in history to do so—and showcasing how personal this case is to the president.
On his first day back in office, Trump signed an executive order to deny citizenship to children born in the U.S. to noncitizen parents. Six courts blocked it as unconstitutional under the 14th Amendment—but the administration kept pushing, betting it could get a friendlier outcome from the Supreme Court. That gamble is now playing out in real time: SCOTUS heard arguments today.
Birthright citizenship has been a cornerstone of equality in our country for more than 150 years, and we won't allow Trump to rip it away. Add your name to ensure no child grows up stateless in the country where they were born.
If Trump gets his way, millions of children could be left stateless and denied basic rights in the only country they've ever known. Babies born in U.S. hospitals could grow up without citizenship—cut off from health care, social services, and basic legal protections. Parents would face costly, uphill legal battles just to prove their children belong here.
Ending birthright citizenship would require a constitutional amendment, regardless of the Supreme Court ruling. That's why we're calling on Congress to hold the line and be the final line of defense if SCOTUS rules in Trump's favor.

The Trump administration is using racist ideology to underpin its arguments in front of the Supreme Court, referencing the legal framework that led to segregation and Jim Crow in its attempts to overthrow the 14th Amendment.2
With Trump's MAGA allies in Congress emboldened, every member needs to be held accountable—especially as Representative Andy Barr is already pushing a constitutional amendment to permanently end birthright citizenship.3

The Supreme Court just gave the green light for Trump to end birthright citizenship, a constitutional right that has been guaranteed under the 14th Amendment for over 150 years.4 Birthright citizenship is the simple principle that everyone born in the U.S. is automatically a citizen.
Mia, this ruling opens the door to one of the most dangerous rollbacks of civil rights in modern U.S. history. By allowing Trump's EO to end birthright citizenship to be decided by the federal courts in select parts of the country, SCOTUS has greenlit creating a two-tiered system of citizenship.
But it doesn't have to end here. Ultimately, federal courts will have to rule on birthright citizenship, and if they rule to overturn it, it will be up to Congress to block these unconstitutional grabs at our rights. Add your name to the petition demanding Congress defend the rights of all people born in this country and reject Trump's attempts to rewrite who gets to be an American.
