Reformers have been pushing Biden to add more seats to the Supreme Court to address the imbalance that has developed there in recent years. In response to these calls, Biden just created a bipartisan 36-member commission to study the possibility of expansion. And several members of Congress just proposed a bill to add four seats to the Supreme Court. These proposals are an urgent response to the threat the current Supreme Court poses to our democracy—with right-wing justices making critical decisions that result in decades of consequences. Trump appointed three justices over the course of his term, locking in a right-wing upper hand for decades to come. Five of the current right-wing Supreme Court justices have been sworn in by Republican presidents who lost the popular vote. It's time for President Biden to expand the number of justices that serve. Sign the petition: President Biden and Congress must protect democracy and expand the Supreme Court! In 2016, Senate Republicans blocked Obama's Supreme Court appointee, citing the imminent election. Then, they rushed to fill multiple empty seats over Trump's presidency, including RBG's just one week before the 2020 election. Adding seats to the Supreme Court is a way to keep in check the power that any one president can have over its makeup. The Constitution does not set the number of justices that serve on the Supreme Court -- Congress does. In addition to pushing for more seats, reformers have been advocating for setting term limits, establishing a code of ethics, formalizing the process by which judges are withdrawn, and expanding lower courts to accommodate growing caseloads.3 With a whopping six right-wingers and only three justices who are more progressive, the current Supreme Court is poised to roll back even more democratic protections and basic rights.
