The Supreme Court is bending the knee to Trump. Despite more than 150 years of settled constitutional precedent, SCOTUS has now agreed to hear Trump's challenge to end birthright citizenship, opening the door to the most extreme rollback of citizenship rights in modern history.1
On his first day back in office, Trump issued an executive order denying citizenship to children born in the U.S. to noncitizens. Six lower courts have blocked the implementation of Trump's executive order under the 14th Amendment, but the administration pushed forward anyway, aiming for a more sympathetic SCOTUS ruling.2 Now, despite the repeated lower court defeats, SCOTUS has agreed to hear the case this spring: exactly the outcome Trump has been betting on.
Ending birthright citizenship would require a constitutional amendment—not a president's decree, not a court bowing to political pressure. Congress must hold the line and be the final line of defense if SCOTUS rules in Trump's favor. Meanwhile, Trump's MAGA allies in Congress, including Representative Andy Barr, are advancing a constitutional amendment to end birthright citizenship.

The Supreme Court just gave the green light for Trump to end birthright citizenship, a constitutional right that has been guaranteed under the 14th Amendment for over 150 years.4 Birthright citizenship is the simple principle that everyone born in the U.S. is automatically a citizen.
Mia, this ruling opens the door to one of the most dangerous rollbacks of civil rights in modern U.S. history. By allowing Trump's EO to end birthright citizenship to be decided by the federal courts in select parts of the country, SCOTUS has greenlit creating a two-tiered system of citizenship.
But it doesn't have to end here. Ultimately, federal courts will have to rule on birthright citizenship, and if they rule to overturn it, it will be up to Congress to block these unconstitutional grabs at our rights. Add your name to the petition demanding Congress defend the rights of all people born in this country and reject Trump's attempts to rewrite who gets to be an American.
