Despite more than 150 years of settled constitutional precedent, SCOTUS has now agreed to hear Trump's challenge to end birthright citizenship, opening the door to the most extreme rollback of citizenship rights in modern history.1 On his first day back in office, Trump issued an executive order denying citizenship to children born in the U.S. to noncitizens. Six lower courts have blocked the implementation of Trump's executive order under the 14th Amendment, but the administration pushed forward anyway, aiming for a more sympathetic SCOTUS ruling.2 Now, despite the repeated lower court defeats, SCOTUS has agreed to hear the case this spring: exactly the outcome Trump has been betting on. Ending birthright citizenship would require a constitutional amendment—not a president's decree, not a court bowing to political pressure. Congress must hold the line and be the final line of defense if SCOTUS rules in Trump's favor.
