In a decision released this morning, the MAGA justices gave Donald Trump a huge gift: They played right into his legal strategy to avoid accountability for attempting to illegally overturn the 2020 presidential election.1

The court's decision means that Trump will not be prosecuted for his attempt to overthrow American democracy until after the 2024 presidential election. It could even derail the case entirely.

Andra, justice delayed is justice denied.

A federal appeals court had already ruled unanimously against Trump, calling his actions, in a strongly worded opinion, "an unprecedented assault on the structure of our government."2 But now the Supreme Court's intervention means that, if Trump is reelected this November, he will have the power to direct the Justice Department to drop the charges against him.

One thing is crystal clear: The Supreme Court will not save our democracy or our nation from Trump. In fact, they're openly enabling him.

But as our politics have become more divisive and polarized, the number of swing voters has diminished significantly. In other words, there are very few voters who are undecided between President Biden and Trump.

In their place, a different kind of voter has grown more important: one who vacillates not so much between parties or candidates but between voting and not voting.

A "nonvoter" can transform into a voter at any time—and if most of them break in the same direction, their decision to participate can be decisive.
