Supreme Court decision could let the most violent insurrectionists out of jail

Yesterday, in one of several jaw-dropping opinions, the Trump-packed U.S. Supreme Court sided with the January 6 insurrectionists who stormed the U.S. Capitol in an attempt to block the certification of the 2020 presidential election.

Yesterday, in one of several jaw-dropping opinions, the Trump-packed U.S. Supreme Court sided with the January 6 insurrectionists who stormed the U.S. Capitol in an attempt to block the certification of the 2020 presidential election.1

The court ruled that a law that makes it a crime to obstruct or impede an official proceeding—in this case, Congress counting the Electoral College ballots—was limited to destruction of evidence or documents and so could not be used against the January 6 insurrectionists.2

The decision could impact Trump's own election interference case and will upend more than 350 cases against the most violent January 6 insurrectionists.3

The case was brought by insurrectionist Joseph Fischer, an off-duty Pennsylvania police officer, who recorded a four-minute cellphone video at the Capitol on January 6 in which he is heard yelling, "charge," and is seen in a scrum with police officers. Prior to January 6, Fischer wrote in a text message: "take Democratic Congress to the gallows….can't vote if they can't breathe lol." When the FBI arrested him, he shouted profanities at the agents and at his own police chief.4

In anticipation of the Supreme Court's decision, some judges already allowed some convicted insurrectionists to be released from prison early. Now, many more will be resentenced, retried, or simply released.5

Andra, the next president likely will nominate at least two additional Supreme Court justices. That CANNOT be Donald Trump.
