The plot thickens: Last week, in a massive public relations stunt, the dangerous dark-money group No Labels took the outrageous step of asking the Justice Department to investigate MoveOn for criminal harassment, extortion, and "unlawful conspiracy" under RICO—the law often used to prosecute organized crime(!)—because we have been organizing to expose their plot that would reinstall Donald Trump in the White House.1
MoveOn is not backing down. We refuse to succumb to their scare tactics. We will not be intimidated or silenced. Instead, we're as committed as ever to stopping No Labels. And we are not alone!
Yesterday, End Citizens United and Accountable.US filed complaints with the Federal Election Commission and Internal Revenue Service, accusing No Labels of breaking campaign finance and tax laws.2 Unlike the Democratic and Republican parties, No Labels refuses to disclose all of its donors and is accepting unlimited sums of money from fat cats and billionaires, who we've learned include Harlan Crow—the collector of Nazi memorabilia and funder of Clarence Thomas's extravagant lifestyle—Fox News's owner Rupert Murdoch, and billionaire investor Nelson Peltz, a major Trump backer.3,4
And there's more, which we'll get to in a moment. But first, we need to be forthright: MoveOn had NOT been planning for a legal fight with No Labels. But now we need to be prepared. And our legal costs could add up VERY fast, which is particularly challenging for us in an election year where we're all-in to defeat Trump and stop his fascist plans before it's too late. There are two more new developments with No Labels.
In addition to the new accusations that No Labels broke federal election and tax laws, two of its donors from the powerful Durst real estate empire sued the group on Monday, saying that No Labels pulled a "bait and switch" by seeking donations to promote bipartisanship but instead "becoming the organization behind a quixotic third-party candidacy that could skew the most consequential presidential election of our lifetime."5
Their lawyer said, "The Dursts believe they were sold a bill of goods, and they want no part of it."6
Also on Monday, Laurence Tribe, one of the nation's top constitutional lawyers, "blasted" No Labels, saying that the organization is now "openly floating" a scheme to have the U.S. House of Representatives, which is controlled by MAGA extremists—rather than voters—decide the 2024 presidential election. Tribe warned, "No Labels is a lethal scam. It could end democracy if it tosses the 2024 presidential election into the House, where each state has exactly one vote."7
MoveOn is in good company. But we cannot let up on the gas. No Labels is a very serious threat, in part because of the eye-popping $70 million they plan to spend to influence the outcome of the presidential election.
And while their request for the Justice Department to investigate MoveOn for criminal conspiracy is laughable, we still have to prepare to defend ourselves if we need to. And legal bills are no laughing matter.
