Dear MoveOn member,
It's official: The Supreme Court will decide if Donald Trump is eligible to run for president of the United States after inciting a deadly insurrection on January 6, 2021.1
News that the high court will take up the question comes just days after Colorado and Maine moved to strike him from their states' ballots, with the Colorado Supreme Court and Maine's secretary of state both affirming that Trump's actions leading up to and on January 6 violate the clause in the 14th Amendment that bars public officials who have "engaged in insurrection" or "given aid and comfort" to insurrectionists from holding office again.2,3
Andra, there is a chance—a real, tangible chance—to kick Trump off the ballot and out of our politics once and for all. Now it is our responsibility to turn up the pressure on the Supreme Court justices to do the right thing and uphold the Constitution, and we have a quick and easy way for you to help visibly show support for holding Trump accountable.
Removing Trump from the ballot is not some progressive pipe dream, Andra. Lawyers across the ideological spectrum support his removal, and there are at least 16 additional states with pending court cases calling for Trump to be barred from office based on his violation of the 14th Amendment.4,5
And if the conservative justices on the Supreme Court actually believe in following a strict and literal interpretation of the Constitution, as they have so often claimed in the past, then they have no choice but to disqualify Trump.
Now, we know that the court is packed with Trump loyalists who are likely to do his bidding no matter what, but regardless of what happens, we cannot let up on the drumbeat of calling out Trump for his corruption and criminality. We must make sure that voters, many of whom will not have been closely monitoring Trump's indictments and trials, know the extent of his crimes before they head to the ballot box.
